大渕愛子弁護士、業務停止期間が明けブログ更新 テレビ出演は当面見合わせ

依頼人から着手金を不当に受け取ったとして、
先月に東京弁護士会から業務停止1ヶ月の懲戒処分を受けていた大渕愛子弁護士が2日、自身のブログを更新。
9月になり業務停止期間が明けたが、テレビ出演に関しては「当面見合わせさせて頂くことといたしました」と報告した。

1ヶ月ぶりに更新したブログで、寄せられた応援のコメントに感謝し、
「この1ヶ月間は、これからの自分の在り方を考えるための意味のある時間でした」と回想。
テレビ出演についても検討を重ねた結果、
「出産を控えていることもありますし、まずは弁護士業務の見直し、再構築を行うべきだと思いました」との理由から、
当面見合わせとなった。
大渕弁護士は現在第2子を妊娠中で、12月に出産予定となっている。

続けて、
「皆様からご信頼頂ける弁護士へと成長するためにそのような時間が必要であるという考えに至りました」
と弁護士としての成長を改めて宣言。
復帰時期は明言していないが、ブログの更新は
「これまで日課として続けてまいりましたので、これからも、できる範囲で続けて行こうと思っております」とした。

大渕氏は、2010年10月に女性から養育費請求の依頼を着手金17万8500円などで受任。
しかし、依頼人が日本司法支援センター（法テラス）の弁護士費用を建て替える「民事法律扶助（代理援助）」を
利用したにもかかわらず、法テラスが定めた額以上に受け取ったと8月2日の会見で説明。
東京弁護士会はこれらの行為について「弁護士としての品位を失うべき非行」であるとし、大渕氏に業務停止1ヶ月の懲戒処分を下した。

また、大渕氏が所属する芸能事務所・タイタンの顧問で大渕氏の代理人弁護士を務める橋下徹氏は文書で、
「弁護士としての品位を失うべき非行」の基準があいまいであることや、
「３年間の除斥期間が経過しており、懲戒手続きは開始できないのではないか」と法的手続き上の疑義を指摘。
弁護士による過去の不祥事案件の処分例と比較し「戒告」が相当で業務停止は「著しく重い処分であり、不当」と声明を発表した。
